We assist you in the trademark search by performing the search using a trademark (™) director. We go through a detailed process of checking on the trademark logo and brand name that you have chosen for your products to make sure that it is not currently registered under anybody else’s name. The trademark can only be registered if it is found to be unique and distinctive. If the logo or brand name that you have chosen already exists and is registered to someone else, we will then provide you with the ways for its modification so that your application does not get rejected. 

Class Selection

The trademark gives you the right to sell your products under a specific brand name within a certain sector in the economy of India. There are around 45 sectors and every sector is named as a class. Preparing The Application

Trademark Examination

If the Trademark contains symbolic elements or logo, then such applications will be prepared under Vienna codification. A Vienna code is allocated to it as per the Vienna Agreement. It takes around 3-5 working days. Once the Trademark Application is filed, it is investigated by the examiner for any disparities. The Tm Registration Process of examination could take about 1-2 months. The examiner could either accept the trademark absolutely, conditionally or object. If the trademark gets accepted unconditionally, it will get published in the Trademark Journal. If it does not get accepted unconditionally, there might be some conditions or the objections mentioned in the examination report that needs to be fulfilled.  The response to fulfill the conditions or objections should be provided within a month. When such a response is accepted, the trademark gets published in the Trademark Journal and if the response is rejected, you can request a hearing. During the hearing, if the examiner feels that the trademark should be allowed to register, it undergoes for publication in the Trademark Journal
